Legal Services
The GDC’s Office of Legal Services (Legal Services) provides in-house counsel to the Commissioner and staff on a multitude of transactional legal matters, such as contracts, employment law issues, administrative regulations, legislation, and standard operating procedures. Legal Services also liaises with the Attorney General’s Office on pending litigation against the agency and GDC employees. The General Counsel serves as the Agency Ethics Officer and the Commissioner’s designee on the State of Georgia Claims Advisory Board.
Legal Services is responsible for responding to all requests for access to the GDC’s records. Among the types of requests handled are the following:
- Requests for public records under the Open Records Act, O.C.G.A. §50-18-70, et seq.;
- Responses to subpoenas and requests for production of documents in pending litigation;
- Requests for access to offenders’ medical records under HIPAA; and
- Requests for declassification of offender institutional and central office files, which are confidential state secrets under O.C.G.A. §42-5-36.
